01 Acceptance of Terms

By downloading, installing, or using BerryBoard ("the App"), developed by İlknur Tulgar ("Developer", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

These Terms apply to all users of BerryBoard, regardless of location. Use of the App constitutes your full acceptance of these Terms and any future updates to them.

02 Description of Service

BerryBoard is a real-time collaborative drawing application built with Flutter. It allows users to create, share, and collaborate on digital drawing boards from any device.

03 User Responsibilities

By using BerryBoard, you agree to use the App responsibly and lawfully. You agree not to:

• Create, share, or distribute drawings that contain illegal, harmful, abusive, hateful, or sexually explicit content
• Use the App to harass, threaten, impersonate, or defame any individual or organisation
• Attempt to reverse-engineer, decompile, modify, or interfere with the App's systems or underlying code
• Use automated means (bots, scripts, crawlers) to access or overload the App's services
• Attempt to gain unauthorised access to another user's boards or account
• Violate any applicable local, national, or international laws or regulations
• Generate or share content that infringes on the intellectual property rights of others

We reserve the right to suspend or permanently terminate access for any user who violates these Terms, without prior notice.

04 User-Generated Content

BerryBoard allows you to create and share drawing boards. You retain ownership of the content you create. By using the App, you grant us a limited, non-exclusive licence to store, display, and synchronise your content solely for the purpose of operating the service.

You are solely responsible for the content you create, upload, and share within the App. We do not review user-generated content before it is published or shared.

05 Subscription Plans

BerryBoard offers optional subscription plans (Monthly and Annual) that unlock premium features. Subscriptions are processed and managed through Google Play Billing.

• Billing — Subscription fees are charged to your Google Play account upon confirmation of purchase.
• Auto-renewal — Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation — You may cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the unused portion of a period.
• Price changes — We reserve the right to adjust subscription pricing. You will be notified of any price changes in advance and given the opportunity to cancel before they take effect.
• Free trials — If a free trial is offered, it will be clearly stated at the time of sign-up. Unused trial days are forfeited upon cancellation.

All subscription transactions are subject to Google Play's own terms and refund policies. For refund requests, please contact Google Play support directly.

06 Intellectual Property

All trademarks, logos, branding, App design, and source code associated with BerryBoard are the intellectual property of İlknur Tulgar. You may not use, copy, reproduce, or distribute any part of the App without prior written permission.

The visual assets and screenshots displayed on the Google Play Store were designed by Betül Kara and are used under license by the Developer.

The App's UI, iconography, and overall product design are original works and may not be replicated in other products.

07 Disclaimer of Warranties

BerryBoard is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted, error-free, or continuously available
• Real-time synchronisation will be instantaneous or free from latency under all network conditions
• The App will be free of bugs, viruses, or other harmful components
• Data stored in the App will never be lost due to technical failure

Your use of the App is entirely at your own risk. We strongly recommend keeping local backups of important creative work.

08 Limitation of Liability

To the fullest extent permitted by applicable law, İlknur Tulgar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

This includes, but is not limited to, any loss of data, creative work, revenue, or business opportunity resulting from service interruptions, bugs, or other technical issues.

09 Third-Party Services

BerryBoard integrates with third-party services including Google Firebase, RevenueCat, and Google Play Billing. These services operate under their own terms of use and privacy policies, which may also apply to you as a user of BerryBoard.

We are not responsible for the practices, availability, or content of these third-party providers. Integration with these services does not constitute an endorsement of them.

10 Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be communicated via an in-app notice or through our website. Continued use of the App after any modifications constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict-of-law principles. Users located in the European Economic Area may additionally have rights under applicable EU consumer protection laws.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, unless otherwise required by applicable mandatory law.
